1. General Terms of Use (GTU)
Article 1 – Purpose
These General Terms of Use govern access to and use of the Divinative platform. Divinative is a marketplace connecting consultants specializing in the divinatory arts (“Psychics” or “Advisors”) with users (“Clients”).
In particular, the platform offers:
- phone consultations;
- video consultations;
- chat consultations;
- group sessions (Group Calls);
- monthly subscriptions;
- the sale of digital content.
Article 2 – Minimum age
Use of the platform is strictly reserved for persons aged 18 or over. By creating an account, the user declares that they are at least 18 years old.
Article 3 – Nature of the services
The consultations offered on Divinative are provided for entertainment, personal development and personal reflection purposes.
Under no circumstances do they constitute medical, psychological, financial, legal or investment advice. Users remain solely responsible for their decisions.
Article 4 – Account creation
The user undertakes to provide accurate information, to keep it up to date and to keep their login credentials confidential.
Article 5 – Payments
Payments are processed via Stripe and Stripe Connect Express. Divinative acts as a platform for connecting parties and collecting payments.
Amounts charged include, where applicable, VAT and applicable local taxes. For digital content and services supplied to consumers, the applicable VAT may be that of the client’s country of residence.
Article 6 – Phone consultations and 0901 premium-rate numbers
Phone consultations may be charged in two ways:
- by electronic payment via Stripe (available regardless of the caller’s country);
- via a 0901 premium-rate value-added number, available only for calls from Switzerland.
For calls via a 0901 number, in accordance with Swiss regulations (OFCOM):
- the applicable rate is announced clearly and legibly before the call is connected, and is displayed as prominently as the number itself;
- rates comply with the legal caps: CHF 10/minute, a basic charge of CHF 100 per call and CHF 400 in total per call;
- where the rate exceeds CHF 5/minute, the caller must expressly confirm their acceptance during the call;
- the number is never dialed automatically from the application: a confirmation window is displayed before any call;
- the client remains responsible for the call charges billed by their operator.
Article 7 – Monthly subscriptions
Subscriptions have no commitment, renew monthly and can be canceled at any time. They remain active until the end of the period already paid for.
Article 8 – Group Calls
Group sessions are neither recorded nor available for replay.
Article 9 – Digital content
Psychics may publish photos, videos, downloadable files and paid content. This content remains the intellectual property of its author. Any unauthorized reproduction is prohibited.
Article 10 – Recording of consultations
Audio and video consultations are not recorded by the platform.
Recording, capturing, broadcasting or reproducing a consultation is prohibited, whether by the Client or by the Psychic, unless both parties have given their mutual, prior and written agreement.
Please note that recording a non-public conversation without the consent of all participants constitutes an offense under Swiss criminal law (in particular Art. 179bis et seq. of the Swiss Criminal Code).
Article 11 – Right of withdrawal
Consumers residing in the European Union are in principle entitled to a 14-day withdrawal period for distance contracts. An equivalent right may apply under the mandatory provisions of the client’s country of residence.
However, by requesting the immediate performance of a consultation or immediate access to digital content, the client:
- expressly consents to the service beginning before the end of the withdrawal period;
- acknowledges that they lose their right of withdrawal once the consultation has been fully performed or the digital content has been viewed / downloaded.
Article 12 – Refund policy
Subject to mandatory legal provisions and to Article 11 above:
- completed consultations are non-refundable;
- digital content already viewed is non-refundable;
- subscriptions already billed are non-refundable for the current period.
Divinative reserves the right to offer a goodwill gesture.
Article 13 – Chargebacks
In the event of an abusive or fraudulent dispute, Divinative may suspend the account, refuse any further use of the platform and take legal action.
Article 14 – Account suspension
Divinative may suspend or close an account in the event of fraud, abuse, inappropriate behavior or failure to comply with these terms.
Article 15 – Limitation of liability
Divinative is bound only by an obligation of means (best-efforts obligation). The company does not guarantee any result, any prediction or the accuracy of the consultations.
Article 16 – Governing law and jurisdiction
These GTU are governed by Swiss law. The competent courts are those of the Canton of Geneva.
If you are a consumer residing in the European Union or in Canada, you also benefit from the mandatory consumer protection provisions of your country of habitual residence, which are not affected by this clause.
2. Special terms for Psychics
Psychics are independent service providers. They freely set their own hours and rates and remain responsible for their tax obligations. Divinative is not their employer.
Payments
Earnings are collected by Divinative and then paid out to psychics via Stripe Connect Express. Funds become available after a holding period intended to cover refunds, fraud and chargebacks.
Invoicing
The psychic is responsible for their tax obligations and for issuing their invoices.
Content
The psychic warrants that they hold all rights to the content they publish.
3. Subscriptions to advisors’ content
Where this feature is offered, the user may take out a paid subscription
giving access to certain content published by an advisor on the Divinative platform.
For as long as the subscription is valid, it gives access to the content
made available by the advisor in the relevant area, according to the visibility settings
defined on the platform.
The user expressly acknowledges that the subscription constitutes a right of access to the content
available during the subscription period. It does not constitute the purchase of a set number
of posts, videos, messages, lives, personalized replies or future content.
Unless expressly stated otherwise at the time of subscription, Divinative and the advisor do not
guarantee:
● any minimum number of posts;
● any minimum posting frequency;
● that any specific content will remain available permanently;
● any individual reply from the advisor as part of the subscription;
● any included private consultation;
● any result, personalized advice or particular benefit.
The advisor remains free to determine their posting pace, the topics covered and the
content offered, in compliance with the platform’s rules, the Code of Ethics and
applicable law.
Some content may be added, modified, removed, suspended or made unavailable,
in particular in the event of deletion by the advisor, expiry, moderation, complaint,
technical issue, breach of Divinative’s rules or legal obligation.
The removal or absence of new content does not automatically entitle the user to a
refund, provided that the user has had access to the content available
during the subscription period, subject to applicable mandatory rights.
4. Term, renewal and cancellation
Unless otherwise stated at the time of subscription, the subscription is taken out for a monthly
period and renews automatically for successive one-month periods.
The price, currency, billing frequency, renewal date and any applicable taxes
are shown before the subscription is confirmed.
The user may cancel their subscription at any time from their customer account. Cancellation
takes effect at the end of the current subscription period. The user retains access to the
relevant content until that date, except in the event of suspension or termination for breach of the
Terms of Use.
No further payment is taken after the effective cancellation date.
5. Subscription refunds
Subscriptions give access to the content available during a set period. Unless
otherwise required by law, the following situations do not automatically entitle the user to a
refund:
● the advisor does not publish new content during the subscription period;
● the user has not viewed the available content;
● the user is not satisfied with the pace, style or topics of the posts;
● the user changes their mind after accessing the content;
● specific content is removed for a legitimate reason.
Divinative may nevertheless grant a full or partial refund, at its reasonable discretion
or where required by law, in particular in the event of a billing error, duplicate payment,
major unavailability attributable to the platform, proven fraud or substantial removal
of access immediately after subscribing.
6. Content publication by advisors
The advisor offering a subscription is responsible for the content they publish and for its
compliance with Divinative’s rules.
The advisor understands that subscribers pay to access the content available in
their area during the subscription period, and not to receive a guaranteed number of
posts.
The advisor nevertheless undertakes not to present their subscription in a misleading way. If they
explicitly announce a posting pace, a series, a program or a specific
benefit, they must use their best efforts to honor that announcement or inform
subscribers of any substantial change.
The advisor may not promise a result, a guaranteed prediction, a systematic personalized
reply or an included private consultation, unless that service is
expressly included in the displayed offer and technically available.
